Driving Fine - Advice Needed
The good folk of WHO...

The wife on Friday had TWO driving offences come through which happened in January and March LAST YEAR, they are now demanding over £500 however these are the first letters we've had come through.

The offence was doing a right hand turn to come back on herself on the A12 near the big BnQ by Gallows Corner, spun round to come back home for whatever reason.

My question is, is there a time limit the council have to write to you in order to demand payment for a road offence? Also, the mrs spoke to them today and they "claim" to have wrote to our old address which we moved from 2 years ago, all the car documentation has been registered to the new address and the wife is registered on the electoral role so piss easy to locate.

Surely we wouldn't have to pay the full fucking lot at their incompetence of finding the right fucking address?

Normally there’s a time limit to send things out, if they sent it to an old address and her car is registered at the new one, that’s on them.

There is a 14 day limit on "certain" offences and I think for others it's 28 days.

Google the offences then if I'm correct reply quoting the law and you shouldn't have to pay anything.
I did with Newham once and won, after I went in a bus lane but they took months to let me know.

They said we have to get a solicitor to oversee the appeal as well? Never heard of that before.

Tried googling and I had found about 3/4 different timescales.

The odd thing was the letter came from Newham Council, however the offence was within HAVERING?

"Many motoring offences are summary only which means they can only be tried in a magistrates’ court. These are subject to an overall time limit within which to bring proceedings of six months. There are some statutory exceptions to this and this time limit may be extended for certain offences and in certain limited circumstances"

Came through all legit, Newham Borough on the envelope on headed paper etc... Where she works there's a solicitor above her office, she's taking legal advice on it.

You could try citizens advice?
It is hard to find a definitive answer on google but my guess is if they are offences caught on camera they are well over the time limit.
If reported by police then it's 14 days.
Either way as long as you changed your address with the DVLA in good time I reckon you'll pay nothing.

PCN needs to be issued within 6 months of the offence.

You'll get 28 days to pay the fine which will be reduced if you pay in 14 days.

Once your appeal is logged, this puts a stop on the escalation of the fees. So my advice is to log an appeal at the very least. even if you lose your appeal you can still pay the reduced rate. (I'm not 100% on that bit)

Most London Boroughs do not send anyone to represent them at the tribunals, so if you show up you usually win them.

Havering and Newham have some kind of agreement where lots of services are linked.
